Acceptance of Terms

By downloading, installing, or using Mosey Tour Builder ("the app"), you agree to these Terms of Use. If you do not agree, please do not use the app.

These Terms apply to all versions of Mosey Tour Builder available on the Apple App Store.

License to Use the App

Geoff Baron grants you a limited, non-exclusive, non-transferable, revocable license to use Mosey Tour Builder for your personal, non-commercial purposes, subject to these Terms.

You may not:

• Copy, modify, or distribute the app or any part of it.
• Reverse-engineer, decompile, or attempt to extract the source code.
• Use the app for any commercial purpose without our express written permission.
• Use the app in any way that violates applicable laws or regulations.

Generated Content & Accuracy

Mosey Tour Builder uses Anthropic's API and third-party data (Google Places) to generate walking tours, stop suggestions, and narration. Generated content may contain errors, inaccuracies, or outdated information.

You acknowledge that:

• Tours are generated automatically and have not been individually reviewed or verified by us.
• Venue information (hours, ratings, accessibility) may not reflect current real-world conditions.
• Historical and descriptive narration sourced from Wikipedia may contain inaccuracies.
• You should verify important information independently before relying on it (e.g., confirming a venue is open before traveling to it).

We are not responsible for any decisions you make based on tour content generated by the app.

Safety

Do not use Mosey Tour Builder while driving or operating a vehicle. The app is designed for pedestrian use only. You are responsible for your personal safety and the safety of those around you while using the app. Always be aware of your surroundings, obey traffic laws, and use crosswalks and sidewalks appropriately.

We are not responsible for any accidents, injuries, or property damage that occur while you are using the app.

In-App Purchases & Subscriptions

Mosey Tour Builder offers a free tier (3 lifetime tours) and a paid subscription called Mosey Pro.

Mosey Pro Subscription

• Mosey Pro is available as a monthly subscription ($2.99/month) or an annual subscription ($19.99/year).
• Subscriptions are processed and managed by Apple through the App Store.
• Subscriptions automatically renew at the end of each billing period unless cancelled.
• To cancel, go to iOS Settings › [Your Name] › Subscriptions and cancel Mosey Pro at least 24 hours before the renewal date.
• You will not receive a refund for the current billing period after it has started.
• Prices are subject to change. We will provide reasonable notice of any price changes.

Refunds

All refund requests for App Store purchases must be submitted directly to Apple. We do not process refunds ourselves. You can request a refund at reportaproblem.apple.com.

App Availability & Changes

We reserve the right to modify, suspend, or discontinue the app (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the app.

Features described in marketing materials represent current functionality and may change with app updates.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GEOFF BARON DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• THAT THE CONTENT OR INFORMATION PROVIDED BY THE APP WILL BE ACCURATE, COMPLETE, OR RELIABLE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEOFF BARON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Third-Party Services

The app uses third-party services including Anthropic, Google (Places API), and MapLibre. These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of these third-party services.

Intellectual Property

The app name "Mosey Tour Builder," its design, logo, and original code are the intellectual property of Geoff Baron. All rights reserved.

Narration content sourced from Wikipedia is available under the Creative Commons Attribution-ShareAlike 4.0 International License.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Washington State.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the Effective Date above. Your continued use of the app after changes are posted constitutes your acceptance of the revised Terms.
